Article 1 – Definitions

In these General Terms and Conditions, the following definitions apply:

1. Nabuno: the trade name of Commerce4Goods, located in Eindhoven, registered with the Chamber of Commerce under number 88830942, hereinafter also referred to as "we," "us," or "our."
2. Customer: any natural or legal person who places an order via nabuno.com
3. Website: the webshop nabuno.com, including all subpages.
4. Order: a purchase order placed by the Customer via the Website.
5. Business days: Monday through Friday, excluding national holidays.

Article 2 – Applicability

These General Terms and Conditions apply to every offer from Nabuno and to every agreement concluded between Nabuno and the Customer through the Website. By placing an order, the Customer agrees to these terms.

These terms and conditions are available in Dutch. The most recent version is always accessible on our Website. We reserve the right to change these terms. Changes do not apply to orders already placed.

Our Website is hosted on Shopify Inc., which provides us with the e-commerce platform through which we offer our products to the Customer.

Article 3 – Age and capacity

To place an order on our Website, you must be at least 18 years old or have permission from a parent or legal guardian. By placing an order, you confirm that you meet this requirement.

Article 4 – Offer and agreement

All offers on the Website are non-binding. We reserve the right to refuse or cancel orders in the following cases:

• The product is out of stock or unavailable
• We are unable to obtain authorization for your payment
• There is an error in the price or product description
• We suspect the order is fraudulent or intended for resale

If we cancel an order after payment has been received, you will receive a full refund via the original payment method. If we discover a pricing error on an already placed order, we will contact you as soon as possible and offer you the option to reconfirm the order at the correct price or cancel it for a full refund.

The agreement between Nabuno and the Customer is concluded at the moment the Customer receives an order confirmation by email.

We strive to display colors and images as accurately as possible but cannot guarantee that the display on your screen exactly matches the actual product.

Article 5 – Prices and Payment

All prices on the Website include VAT. Nabuno is registered for VAT in the Netherlands under number NL004648091B56. Prices may be displayed in the local currency of the customer's country:

• Netherlands, Belgium, Italy, Spain, Greece, and Slovakia: EUR (€)
• Denmark: DKK (kr.)
• Czech Republic: CZK (Kč)
• Poland: PLN (zł)
• United Kingdom: GBP (£)
• Romania: RON (lei)
• Hungary: HUF (Ft)
  

We accept the following payment methods: BLIK, Visa, Mastercard, Maestro, Apple Pay, and Google Pay. All payments are secured with SSL encryption. We do not store full payment details.

We reserve the right to change prices. Price changes do not apply to already confirmed orders.

Article 6 – Shipping and Delivery

We offer free shipping to the Netherlands, Belgium, Denmark, Italy, Czech Republic, Poland, Spain, Greece, United Kingdom, Romania, Slovakia, and Hungary. All orders are shipped with track & trace and insurance included.

The total delivery time (processing time + shipping time) is:

• Netherlands and Belgium: 5–9 business days

• Denmark, Italy, Czech Republic, Poland, Spain, Greece, United Kingdom, Romania, Slovakia, and Hungary: 8–12 business days.

All countries we ship to are within the European Union. No customs or import fees are charged.

Article 7 – Right of Withdrawal

Under European consumer law, you have the right to cancel the purchase within 14 days of receiving your order without giving any reason. We offer you an extended period of 30 days.

To exercise your right of withdrawal, please contact us via info@nabuno.com with your order number. After approval, you will receive return instructions. Items must be returned unworn and unused, in the original packaging with all labels attached.

Return shipping costs are the responsibility of the Customer (on average €8.95 – €12.95). For damaged, defective, or incorrectly delivered items, return shipping costs are covered by us.

We do not charge a restocking fee.

For a full return, the original shipping costs will be refunded in accordance with European consumer law. Refunds will be made within 5 working days after approval via the original payment method.

Article 8 – Exchanges

Exchanges are possible if you receive the wrong size, a wrong item, or a defective product. For this, contact us via info@nabuno.com with your order number.

Article 9 – Cancellation

You can cancel your order free of charge within 24 hours after placing it, provided it has not yet been processed by our warehouse. If the order has already been shipped, the cancellation falls under the regular return policy.

Article 10 – Statutory Warranty and Product Warranty

Under European consumer law, you are entitled to a statutory warranty of at least 2 years on the conformity of the product. This means the product must match the description, be suitable for the intended use, and have the quality you can reasonably expect.

In addition, we offer an additional product warranty of 1 year. If your item shows a defect within 1 year of the delivery date under normal use, we will provide a replacement or a full refund free of charge.

To file a warranty claim, contact us via info@nabuno.com with your order number and a description and photo of the problem.

This warranty applies to manufacturing defects or material faults under normal use. Damage caused by misuse, accidental damage, or improper care (such as incorrect washing or drying) is not covered.

This warranty does not affect your legal rights as a consumer.

Article 11 – Intellectual Property

All content on the Website, including texts, images, logos, product photos, and designs, is owned by Nabuno or used with permission from the rights holder. It is not allowed to copy, distribute, or otherwise use this content without written permission.

Article 12 – Use of the Website

It is not permitted to use the Website for unlawful purposes, to upload viruses or harmful code, to collect personal information of others, to send spam, to bypass security features, or to provide false or misleading information. We reserve the right to terminate access to our Website if these terms are violated.

Article 13 – Third-Party Links

Our Website may contain links to third-party websites. We are not responsible for the content, policies, or practices of these external websites. Use of third-party websites is at your own risk.

Article 14 – Accuracy of Information

We do our best to keep all information on the Website accurate and up to date. However, unintentional errors may occur in product descriptions, prices, or availability. We reserve the right to correct errors and cancel orders if information on the Website proves to be incorrect. In such cases, you will always receive a full refund.

Article 15 – Limitation of Liability

Nabuno is not liable for indirect, incidental, or consequential damages arising from the use of the Website or the purchase of products, to the extent permitted by applicable law. This limitation does not affect your statutory rights as a consumer under the mandatory consumer law of your country of residence.

Article 16 – Privacy

We process your personal data in accordance with the General Data Protection Regulation (GDPR). Please consult our Privacy Policy for full information on what data we collect, how we use it, and what rights you have.

Article 17 – Complaints and Disputes

If you have a complaint about an order or our service, please contact us via info@nabuno.com
We strive to handle complaints within 14 days.

If we cannot resolve the issue together, you can submit your dispute to a recognized dispute resolution body in your country. An overview of recognized bodies per EU member state can be found at: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies

Article 18 – Applicable Law

These Terms and Conditions are governed by Dutch law. This does not affect your right as a consumer to invoke mandatory consumer protection rules that apply in the country where you live.

Article 19 – Severability

If any provision of these Terms and Conditions is found to be null or voidable, this does not affect the validity of the remaining provisions.

Article 20 – Amendments

We reserve the right to amend these Terms and Conditions. In case of material changes, we will notify you via a notice on our Website and/or by email. Changes do not apply to orders already placed. The most recent version is always available on our Website. If you do not agree with the amended terms, you must stop using the Website.

Article 21 – Legal Rights

Nothing in these Terms and Conditions affects your legal rights as a consumer under Dutch and European consumer law, or the consumer law of your country of residence.
